This is the last Will and Testament of me Richard Prickett of the parish of Christ Church in the county of Surrey Iron Founder made published and declared this second day of June in the year of our Lord one thousand eight hundred and two first I make nominate and appoint my wife Elizabeth Prickett my brother Thomas Prickett and my brother in law Henry Wren executors of this my will and I direct them as soon as conveniently may be after my decease to pay all my just debts funeral expenses the charges of proving this my will and all other necessary and incidental expenses I give and devise unto my said wife Elizabeth Prickett and her assigns for and during so long time as she shall continue my widow and unmarried but no longer one annuity or yearly sum of fifty pounds of lawful sterling money free and clear from all taxes charges and deduction whatsoever to commence from my death and to be paid and payable to her or her assigns by my said executors in xxx and xxxx equal quarterly payments and portions the first payment therof to be made at the end of three calendar months next after my decease But in case my said wife shall happen to marry again after my death then from the time of such marriage I do hereby revoke and make void the said annuity or yearly sum of fifty pounds so hereinbefore given to her as aforesaid and instead thereof I do in such case give and devise unto my said wife one annuity or clear yearly sum of twenty five pounds of like lawful money to be paid and payable to her in like equal quarterly payments for and during the term of her natural life the first xxx payment of such last mentioned annuity to be made at the end of three calendar months next after such marriage of my said wife aforesaid also I give and devise unto my sister Ann Cripps / Gripps the wife of William Cripps / gripps one annuity or yearly sum of ten pounds of like lawful money free from all taxes charges and deductions whatsoever to commence from my death and to be paid and payable to her my said sister by my said executors in even and equal quarterly payment for and during the term of the natural life of the said William Cripps her husband if she shall so long live the first payment thereof to be made at the end of three calendar months next after my decease and in case my said sister Ann Cripps shall happen to survive and outlive the said William Cripps her husband then from the time of the death of the said William Cripps I do hereby revoke and make void the said annuity or clear yearly sum of ten pounds and in lieu thereof I give and devise unto my said sister one annuity or clear yearly sum of twenty pounds of like lawful money to be paid and payable to her by my said executors in like equal quarterly payments for and during the term of her own natural life the first payment of the last mentioned annuity to be made at the end of three calendar months next after the death of the said William Cripps And I do hereby charge and subject and make liable to the payment of the aforesaid several and xxrespective annuities and every of them all my leaseholds messuages buildings lands and premises and parts and shares of leasehold messuages buildings lands and premises and also all the other my personal estate whatsoever and wheresoever and I hereby direct that the said respective annuities or yearly sums of money hereinbefore given and devised to my said wife and my said sister Ann Cripps shall be paid and payable into their respective proper hands for their respective separate use and benefit or to such person or persons as they shall respectively notwithstanding any xxxture from time to time direct or appoint by writing signed with their respective hands and it is my will and mind that neither the said William Cripps nor any future husband of my said wife or of my said sister shall interfere or xxxxxx with the said respective annuities or either of them furtherneither? shall the same or any part thereof be subject or liable to the controul disposition debts or engagements of the said William Cripps or of any such future husband or husbands as aforesaid and I declare that the respective receipts of my said wife and sister signed with their own and respective proper hands shall be good and sufficient discharges to my said executors for the said annuities or for so much thereof respectively as in such receipts shall be xxx or acknowledged to received also I give and bequeath unto my sister Elizabeth Wren wife of the said Henry Wren the sum of one hundred pounds of like lawful money also I give and bequeath unto my brother John Prickett the like sum of one hundred pounds of like lawful money which said two last mentioned respective legacies I desire to be paid by my said executors within one year next after my death also I give and bequeath unto Dinah Day of Mint(??) Street Southwark single woman the sum of five guineas to be paid her by my said executors forthwith after my decease and I direct and desire my said executors to pay unto the said Dinah Day the sum of four shillings weekly and every week for the maintenance or benefit of William Henry Prickett Day her natural son from the time of my death until he shall attain the age of sixteen years but no longer and to whom I give the same accordingly Also I give and bequeath unto the said William Henry Prickett Day the sum of two hundred pounds of like lawful money when and s xxxx as he shall attain the age of twenty five years Also I give and devise unto my nephew Charles Prickett son of my said brother Thomas Prickett and to his heirs and assigns forever all that my household messuage or tenement with the outhouses buildings garden orchard land hereditaments and appurtuances thereto belonging situate lying and being and being in the village of Uckfield?? In the County of Sussex commonly called the Corner House and now in the tenure or occupation of Daniel Clarke his undertenants or assigns also I give devise and bequeath unto my said brother Thomas Prickett his heirs executors administrators and assigns all the first and residue of my messuages or tenements buildings lands hereditaments or parts and shares of messuages or tenements buildings lands hereditaments and premises with their respective appurtenances both freehold and leasehold and whether in possession reversive(??) the remainder expectancy or otherwise and also all the rest and residue of my ready monies and securities for money goods chattels debts effects real and personal estates whatsoever and wheresoever and of what nature kind or quality soever for the same whereof I shall die possessed and which shall be any ways due owing or belonging to me or in or to which I may be any way interested or entitled at the time of my decease and all my estate and interest therein subject nevertheless to and xxxx (charged?? and xxxxxable (chargeable??) with the payment of the several and respective annuities or yearly sums of money hereinbefore given to my said wife and my said sister Ann Cripps to hold the same real and personal estates and effects last mentioned and every of them and every part thereof with their respective appurtuences ?? so subject and chargeable as aforesaid unto and to the use and Xxxxof of my said brother Thomas Prickett and of his heirs executors administrators and assigns absolutely and for ever and ever and I do hereby declare it to be my will and meaning that my said executrix and executors shall not be answerable or accountable the one for the other or others of them or for the act or acts defaults receipts payments or xxxxx of each other or others of them or be charged or chargeable with or accountable for any further or other sum or sums of money interest dividends or produce than what shall annually come to the hands of and be received by them respectively under the trusts of this my will notwithstanding? they or either of them shall give or sign or join and concur in giving or signing of any receipt or receipts for the saxe of conforxxxy and that they or either shall not be answerable or accountable for the desufficiency??? Defect or failure of any trust fund xxxx any part of my said personal estate may be invested or lodged nor for any involuntary loss or damage which shall or may happen to arise in the execution of this my will and also that it shall and may be lawful to and for my said executrix and executors and each of them from time to time and at all xxx to have xxx retain admit and reimburse in the first place to themselves herself and himself and allow to each other respectively xxxx the money which may (now? occur??) to their respective hands all such loss costs charges moneys and expenses as therefore either of them shall respectively bear pay suffer sxxxxxx expend/ expenses?? or be put unto orwhich may be to them or either of them occasionally for or by reason or means or on account of the trusts hereby in them reposed??? the management and execution thereof otherwise howsoever whatever thereto and lastly I do hereby revoke and make void all former and other wills and codicils by me at any time or times heretofore made in witness whereof I the said Richard Prickett the testator have to this my last?/ will and testament contained in this and the two preceding sheets of paper subscribed and set my hand and seal to witt my hand to the two preceding sheets of paper and set my hand and seal to this last sheet the day and year first above written Richd Prickett signed sealed published and declared by the above named Richard Prickett the testator / estator?? This is a Codicil to the last will and testament of me Richard Prickett of the parish of Christ Church in the County of Surry Iron founder which I hereby make and publish on the nineth day of June now last past whereas in and by my said will I have given and devise? Unto my wife Elizabeth Prickett during so long time as she shall continue my widow one annuity or yearly sum of fifty pounds and in case of her marrying again then twenty five pounds per annum during her life Now I do hereby declare and direct that the said annuities so given to my said wife in and by my will shall be upon this express condition that is to say (I trust??) that she my said wife shall and do within three months next after my decease release and discharge all her estate right and interest of and in the freehold messuage or tenement building xxxxxxxxxxments and premises situate and being in Uckfield / Eckfield in the county of Essex and by my said will devised unto my nephew Charles Prickett in fee occur(?) simple and that the costs and charges of such release and discharge ( crossed out two and a half lines reading and her xxxx right and interest of now in the household messuages or tenement outbuildings xxxxxxxxxx and premises situate) and the all be born and paid by my said nephew and in case my said wife shall refuse and neglect to transfer and execute such release and discharge as aforesaid and within the time before mentioned then I do hereby revoke and make void all and every the bequests and devises made to and in favor of my said wife in and by my said will but in case she shall duly and loyally make and execute such release and discharge as aforesaid within the time aforesaid then I give and bequeath unto my said wife over and beside what is given her by my said will the use and reasonable wear and tear of all my furniture and household goods for and during the term of her natural life and after her death then I give and bequeath the same unto my brother Thomas Prickett for his own use and benefit Also I give and bequeath unto William Henry Prickett Day in my said will named the further sum of two shillings weekly and every week to be paid by the executors named in my said will from the time of my death until he shall attain the age of sixteen years subject to the proviso herein after contained also I give and bequeath unto the said Henry Prickett Day the further sum of twenty pounds of lawful sterling money for or towards placing him out an apprentice to such proper trade or business as he may choose and my said executors shall think proper and I do request and desire that my said executors would see that he be properly and legally bound apprentice before they advance and pay the said sum of twenty pounds which I intend should be for or in part of an apprentice fee provided always and I do hereby declare that if the said William Henry Prickett Day shall happen to be bound apprentice as aforesaid before he shall have attained the age of sixteen years then from the time he shall be so bound apprentice I revoke and make void the legacy or sum of two shillings a week hereinbefore given him and also the legacy or sum of four shillings a week given and xxxxxx to him in and by my said will it being my intention that when the said William Henry Prickett Day shall be bound apprentice as aforesaid the payment of the said weekly sums of four shillings and two shillings shall cease and be void and I do hereby ratify and reaffirm my said will in all respects except as the same may be altered or affected / by this codicil in witness thereof I the said Richard Prickett have to the writing which I declare to be a codicil to my said last will and testament and desire to xxxxpted and taken as part thereof set my hand and seal this twelfth day of July in the year of our lord one thousand eight hundred and two R Prickett signed sealed published and declared by the above named Richard Prickett as and for a codicil to his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in his presence and in the presence of each other Jno Winder Mark Underhill J? This Will was proved at London with a codicil the sixteenth day of September in the year of our lord one thousand eight hundred and two before the worshipful Samuel Pearce? Parson? doctor of Laws surrogate of the Right Honourable Sir William Wynne? Knight also doctor of laws Master Keeper or commissary of the perogative Court of Canterbury lawfully constituted by the oaths of Elizabeth Prickett (two half lines illegible) Thomas Prickett (illegible) and every the executors named in the said will to whom admon of all and singular the goods chattels and credits of the said deceased was granted having been first sworn duly to administer
